Front-end Accountability

The Safe Drinking Water and Water Quality Projects Program was created under Proposition 84, which provides $50 million to the California Department of Health Services (CDHS) under Section 75023 for the purpose of providing the state share needed to access federal capitalization grants to assist communities in providing safe drinking water under the Safe Drinking Water State Revolving Fund (SDWSRF) Program. The $50 million is for deposit into the SDWSRF (Section 116760.30 of the Health & Safety Code).

Criteria can be found in Public Law 104-182, the federal Safe Drinking Water Act (SDWA) Amendments of 1996, which authorizes a Drinking Water State Revolving Fund to assist public water systems (PWS) to finance the costs of infrastructure improvements needed to achieve or maintain compliance with SDWA requirements. Federal rules and regulations establishing final program guidelines were promulgated in the Federal Register, Volume 65, Number 152, on August 7, 2000. In 1997, AB 1307(Chapter 374, Statutes of 1997) made changes to conform the California Safe Drinking Water Act [Health & Safety Code Section 116270 et seq] to the1996 federal Act, and established the authority for CDHS to implement an ongoing (revolving) SDWSRF funding program for PWS infrastructure projects, and to receive and manage an annual federal grant award (capitalization grant). This funding allows California to provide both financial and technical assistance to PWS in an effort to assure the public receives safe, wholesome and potable water for domestic use.

Since 2000, this program has provided low interest loans and grants to PWS in California for improvements to drinking water treatment, distribution, and treated water storage facilities (infrastructure). Projects selected for funding under Section 75023 of the Safe Drinking Water & Water Quality Grants Projects Program are required to spend state match funds in accordance with approved project scope and budget contained in each Funding Agreement. Each claim is reviewed by technical staff to ensure conformity to plans and specifications. An interim site inspection visit is conducted on each project along with a final inspection. Administrative staff review claims to ensure mathematical accuracy along with conformity to budgeted amounts, any special contract conditions, and obtain engineering clearance in order to process claims for payment. Each payment request must contain a certification by the borrower or grantee that all expenses claimed are in accordance with the agreement and supporting documentation must be attached to the claim.

All projects funded with state match funds under Section 75023 of the Safe Drinking Water & Water Quality Projects Program receive a final inspection prior to releasing final loan or grant funds for payment of the final claim. The purpose of the final field inspection is to ensure the project has been built according to the plans and specifications contained in the approved funding agreement, which contain the scope of work and the budget. The final payment request must contain a certification by the loan recipient or grantee that all expenses claimed are in accordance with the agreement and supporting documentation must be attached to the claim. All recipients must comply with current laws and regulations which apply to the project and submit documents itemizing total project costs and any additional funding sources, if applicable. Each grant project contains an audit provision in the Funding Agreement that allows for post audits of completed projects and requires the recipient to maintain and make available all accounting records and source documentation necessary to support the charges billed to CDPH.
