Project: Battle Creek Section 1707 Dedication

Description: This proposal requests funds for the following activities comprising the initial phase of the Tompkins Water Right Acquisition Project: • The acquisition of the Tompkins pre-1914 water right on lower Battle Creek, tributary to the Sacramento River, with ownership transferred to the Willow Creek Mutual Water Company (WCMWC) • A petition under Water Code § 1707 to dedicate the water right to instream flow in the lower 7.3 miles of Battle Creek • A change in the point of diversion and place of use pursuant to Water Code § 1706, allowing WCMWC, in cooperation with the US Fish and Wildlife Service (USFWS), to divert the water from the Sacramento River and deliver it to enhance wetlands on private lands managed as part of the Sacramento National Wildlife Refuge Complex • Development of an engineering design to modify the shared headgate structure at the head of the ditch that serves that right, to ensure that the 12 cubic feet per second (cfs) face value of the right remains instream in Battle Creek.
